PourSavvy Terms of Service

These terms are between you and L&N Collective LLC ("we", "us"), a California limited liability company. By using PourSavvy you agree to them. If you don't, don't use the app.

1. Who may use PourSavvy

You must be at least 18 and of legal drinking age where you live (21 in the United States). PourSavvy is not for anyone under that age.

2. What PourSavvy is

PourSavvy reads wine labels and menus from photos and shows an estimated score and information about a standard glass (150 ml / 5 oz). Some values come from producer sources we have researched; others are estimated, and each card says which. It is general information only.

3. Not medical or dietary advice

PourSavvy does not provide medical, allergy, nutrition or dietary advice, and does not diagnose or treat anything.

• Scores, hangover or headache estimates, sulfite or histamine notes, calorie figures, and allergen or vegan warnings can be wrong, incomplete or out of date. A missing warning does not mean a wine is free of an allergen or animal-derived fining agent.
• If you have an allergy, medical condition or dietary restriction, check the label and ask the producer or a professional. Do not rely on the app.
• Drink responsibly. Never drink and drive. Do not drink if you are pregnant, taking medication that interacts with alcohol, or advised not to by a doctor.

4. AI processing

Scanning sends your photo to our servers and to a third-party AI provider (Anthropic) for reading. AI can misread labels. You'll be asked to consent before your first scan. See our Privacy Policy.

5. Subscriptions

• Free use includes 5 bottle scans per month. Shelf and menu scans and unlimited bottle scans require a paid subscription ("PourSavvy Pro"), subject to a fair-use limit of 25 scans per day.
• Price and billing period are shown in the app before you buy.
• Payment is charged to your Apple ID or Google Play account at confirmation. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID or Google Play subscription settings. Deleting the app does not cancel.
• Refunds are handled by Apple or Google under their policies.
• We may change prices with notice; changes apply from your next renewal after notice, and where the store requires it you'll be asked to accept a price increase.
• Restore purchases from the paywall screen.

Apple users: Apple is not a party to these terms and has no obligation to provide support or warranty for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Standard Apple Licensed Application End User License terms also apply; where they conflict, Apple's terms control for matters they cover.

6. Acceptable use

Don't: scrape or copy our wine database or scores in bulk, reverse engineer the app, bypass scan limits or security, send content that is unlawful or not a wine label, overload our systems, or resell the service.

7. Our content

The app, scores, wine database and design are owned by us or our licensors. We give you a personal, non-transferable, revocable licence to use the app. Producer and brand names belong to their owners and are used only to identify wines; we are not affiliated with or endorsed by them.

8. Third-party information

Wine information may come from producers, importers and public sources, which we link or attribute where we can. We don't guarantee it.

9. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, to the extent the law allows, including accuracy, availability, and fitness for a particular purpose.

10. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, gross negligence or wilful misconduct, or death or personal injury caused by our negligence. Subject to that, and to the extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, or for any harm from relying on scores, estimates or warnings, including allergic or adverse reactions. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or US$50. Some places don't allow these limits, so they may not apply to you.

11. Changes and termination

We may change the app or these terms, or suspend access for misuse. Material changes will be shown in the app. Continued use means you accept them. You can stop using the app at any time.

12. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Orange County, California, and you and we consent to that jurisdiction. Consumers in the EU/UK keep their local mandatory rights.
